What is NIL warehousing?

Warehousing is paying for an athlete's NIL rights without saying how, when or for what those rights will be used, which the College Sports Commission says may not satisfy the rules for deals with associated entities and individuals.

An associated-entity deal must include direct activation of the athlete's NIL: the specific uses or licensing categories, the athlete's obligations, the timing and the ultimate use. The CSC's January 2026 data report listed "no direct activation of NIL rights (i.e., warehousing)" among the main reasons deals were not cleared.
