Oregon NIL rules for college and high school athletes

Oregon college athletes can earn NIL money under SB 5 (2021), amended by SB 1505 in 2022, which requires royalties when an athlete's NIL is used on jerseys, trading cards or video games, and by HB 4119 in 2024, which lets schools help athletes find deals. Oregon high school athletes can earn NIL money under OSAA Rule 8.4.4, adopted in October 2022, as long as deals are not tied to performance or recruiting, are disclosed to the school and use no school marks.

Oregon NIL law for college athletes

Oregon's college NIL law began with SB 5, passed in June 2021. SB 1505 (2022) added a requirement that athletes receive royalties when their NIL is used on team jerseys, trading cards or video games. HB 4119 (2024), effective on passage, added "athletic reputation" to the traits athletes may be paid for, let schools directly assist athletes in securing NIL deals, and gave schools liability protections.

In 2025 the Legislature considered HB 3694, which would let schools directly compensate athletes and prospects for their NIL and keep contracts out of public records law. We could not confirm its final passage.

Division I athletes also report third-party deals of $600 or more to NIL Go within five business days.

Oregon high school NIL (OSAA Rule 8.4.4)

The OSAA adopted Rule 8.4.4 in October 2022, effective immediately. A student may earn NIL compensation provided:

  • It is not contingent on a specific performance or achievement.
  • It is not an inducement or recruiting tool.
  • It does not come from the school or its agents, such as employees or booster clubs.
  • It is disclosed to the school.

Students may not use their school's name, mascot, team nickname, logo or insignia in any NIL promotion, and may not promote alcohol, cannabis, prescription pharmaceuticals or any product illegal for people under 18. The OSAA encourages families to get legal and tax advice.
