NIL rules by state
North Dakota NIL rules for college and high school athletes
North Dakota college athletes can earn NIL money under NCAA and College Sports Commission rules and their school's policy, because North Dakota has no state college NIL law. North Dakota high school athletes have been allowed to earn NIL money since the NDHSAA's June 2022 policy, as long as they use no school uniforms or school or league logos, take nothing tied to performance or recruiting, and booster clubs stay out of it.
We could not read the NDHSAA's current rule text; this page relies on news and legal coverage of the 2022 policy.
| Level | Rule | Who sets it |
|---|---|---|
| College | No state statute | NCAA and College Sports Commission rules; school policy |
| High school | Allowed with limits | North Dakota High School Activities Association (NDHSAA) |

North Dakota college NIL: no state law
We found no North Dakota statute on college NIL. Since the NCAA's interim policy took effect on July 1, 2021, athletes at schools in states without an NIL law may take part in NIL activity without breaking NCAA NIL rules, and each school sets its own NIL policy.
Division I athletes also report third-party deals of $600 or more to NIL Go within five business days.
North Dakota high school NIL (NDHSAA)
The NDHSAA Board of Directors approved an NIL policy in June 2022, amending its amateurism bylaws after working with the athletic departments at North Dakota State and North Dakota. Students may pursue NIL opportunities as long as:
- They do not use school uniforms, school logos or league logos in marketing or promotion.
- Booster clubs are not involved.
- The compensation is not used to recruit them to a school and is not for athletic performance.
Because the NDHSAA writes many regulations sport by sport, ask your athletic director how the policy applies to your sport.
