South Dakota college NIL: no state law
We found no South Dakota statute on college NIL. Since the NCAA's interim policy took effect on July 1, 2021, athletes at schools in states without an NIL law may take part in NIL activity without breaking NCAA NIL rules, and each school sets its own NIL policy.
Division I athletes also report third-party deals of $600 or more to NIL Go within five business days.
South Dakota high school NIL (SDHSAA)
The SDHSAA put NIL to a vote of its member schools in spring 2024 as a constitutional amendment, which needed 60% approval. Trackers list it as effective July 1, 2024. Under its guidelines:
- NIL activity may not interfere with the student's academic obligations.
- Pay may not be tied to athletic performance (pay for play).
- Pay may not be an inducement to attend or transfer to a school.
- Pay may not come from the school or its affiliates, such as booster clubs or foundations.
- No school or SDHSAA marks, logos or uniforms, and no school facilities.
